1. Who we are

This store is operated by Prairiestack, trading as Insomniacs Coffee, 9169 W State St #617, Garden City, ID 83714, United States. "We", "us" and "our" mean that business. Our registered details, postal address and contact points are set out in our contact information and legal notice policies, which form part of these terms.

2. These terms

By placing an order on this store you agree to these terms, our shipping policy, our returns and refunds policy, and our contact information and legal notice policies, as they stand at the time you order. If you do not agree with them, please do not order. These terms do not affect any right you have under consumer law that cannot be excluded.

3. What this store sells

This store sells roasted coffee. We do not hold stock: orders are passed to our US roasting partner, who roasts and ships them directly to you. Our shipping policy explains how that affects processing and transit.

Coffee is a perishable food product. Descriptions on this store state the roast level, the country or countries of origin, the format and the weight of what you are buying. We do not make health, certification, allergen or "tested free of" claims about any coffee we sell, and nothing on this store should be read as such a claim.

4. Placing an order

An order is an offer to buy. Our acceptance takes place when we confirm the order by email and the order enters processing with our roasting partner. If we cannot accept an order — for example because the coffee is unavailable, because the delivery address is outside the United States, or because a price or description was clearly wrong — we will cancel it and refund any amount you have paid.

5. Prices, tax and shipping

Prices are shown in US dollars. Shipping is calculated and shown at checkout before you confirm the order. Any sales tax that applies is calculated at checkout. We may change prices at any time, but a change does not affect an order we have already accepted.

6. Subscriptions

If you choose a coffee subscription, these terms apply to it in addition to the rest of these terms:

  • What recurs. A subscription repeats the coffee you selected at the interval you selected at signup — currently every 2 weeks or every 4 weeks.
  • Price. The subscription price is the price shown on the product page at signup, with the subscription discount already applied. It is charged each time a delivery is scheduled.
  • Payment. You authorise us to charge your chosen payment method each time a delivery is scheduled, until you cancel.
  • Cancel any time. There is no minimum term. You can cancel at any time, before your next scheduled charge, by emailing hello@insomniacs.coffee with your order or subscription reference. We will confirm the cancellation by email, and no further deliveries will be charged.
  • Changes. If we change the subscription price or the available intervals, we will tell you by email before the change applies to you, and you may cancel before it takes effect.
  • Ending a subscription for non-payment. If a scheduled payment fails and is not put right, we may pause or end the subscription.
  • Coffee already shipped. Cancelling stops future deliveries. It does not refund coffee that has already been roasted and shipped, except where our returns and refunds policy applies.

7. Delivery

Delivery is governed by our shipping policy. Risk in the goods passes to you on delivery to the address you gave. Please check the address and recipient details before ordering.

8. Returns and refunds

Our returns and refunds policy sets out when a replacement or refund is available. Coffee is perishable and we do not accept returns or refund orders because you changed your mind.

9. Our roasting partner

Coffee sold on this store is roasted and shipped by our US roasting partner under their own terms and policies. We remain responsible to you for the order you placed with us. Our partner's terms do not reduce your rights against us.

10. Acceptable use

You agree not to use this store to break the law, to interfere with its operation or security, to scrape or copy it at scale, or to place fraudulent orders. We may refuse or cancel an order where we reasonably believe it is fraudulent.

11. Our content

The text, images, layout and brand elements on this store belong to us or are used with permission. You may not copy or reuse them commercially without our written permission.

12. Liability

We do not exclude or limit our liability where the law does not allow it, including liability for death or personal injury caused by negligence, and liability for fraud. Subject to that, we are not liable for indirect or consequential losses, or for losses that were not reasonably foreseeable when the order was placed. Our total liability for an order is limited to the amount you paid for that order.

13. Changes to these terms

We may update these terms from time to time. The version that applies to your order is the version published when you ordered. The date at the top of this page shows when it was last updated.

14. Governing law

These terms are governed by the laws of the State of Idaho, United States, and the courts of that state have jurisdiction, except that if you are a consumer you also benefit from any mandatory rules of the country in which you live.
